The applicant also has the right to find out what is in their file with consumer reporting agencies as well as being able to dispute any inaccurate information in their consumer files. After an investigation, if such information is found to be inaccurate, the consumer reporting agency must correct or delete the information from its files.

Damages may be sought from violators of the Fair Credit Reporting Act. If a Credit Reporting Agency, an Employer or even the Background Check Company who provides information from a credit reporting agency violates the Fair Credit Reporting Act, they could be sued by the applicant or employee in state or federal court.
